Red Notice: what it is, how it works and how to challenge it

A Red Notice is a request to law enforcement worldwide to locate and provisionally arrest a person pending extradition, surrender or similar legal action. It is based on an arrest warrant or court order issued in the requesting country.

Not an arrest warrant

INTERPOL cannot compel any country to arrest a person. Each member country applies its own law in deciding what action to take.

Grounds for challenge

  • a predominantly political, military, religious or racial character (Article 3 of the Constitution);
  • incompatibility with human rights (Article 2);
  • non-compliance with the RPD;
  • refugee status granted in relation to the requesting country.

How it is challenged

Through a request for deletion submitted to the CCF.
